You’ll have two years after your accident occurs in Colorado to file a personal injury claim and fight for a settlement. For car accident claims, however, you’ll have three years. The statute of limitations is strict, and you must abide by it if you want the court to hear your case.

Colorado employs a modified comparative negligence law, which states that any individual involved in an accident can sue for damages as long as they’re less than 50 percent at fault. As long as the court determines you’re less than 50 percent at fault for your accident, then you can sue other liable parties for damages. However, the court will deduct your percentage of fault from your overall settlement.
