Denver DUI Resources

Driving under the influence (DUI) is a serious charge in Denver. It can change your life and those of your loved ones in unimaginable ways,, and this is often for the worst.

Whether this is your first DUI charge or not, a DUI lawyer is among the first resources you should acquire to guide you through the process. Different circumstances unique to your case will determine the penalties you’re likely to get should you be convicted. Having legal support will put you at an advantage because a DUI attorney understands the law and how to build an effective defense for such types of charges.

Here are other useful resources that you might need both during and after your case.

The DUI Case Process

You might be wondering the course that your DUI case will take until the court reaches the final verdict. Remember, the stages below are common in most DUIs, but it goes without saying that each case is unique.

For instance, your case might not get to a suppression hearing if your attorney manages to strike a favorable deal with the district attorney (DA).

  • Department of Motor Vehicles (DMV) hearing
  • Arraignment
  • Pre-trial conference with the DA for plea bargaining
  • Suppression hearings
  • Trial
  • Sentencing

BAC Limits in Denver

You can be charged with a DUI and your drivers license suspended if found with a blood alcohol concentration (BAC) of:

  • At least 0.08%, whether you were driving recklessly or not
  • At least 0.05% but below 0.08% for driving while ability impaired (DWAI) charge
  • At least 0.02% for anyone below the age of 21 years
  • At least 0.04% for drivers holding a commercial license.

In addition, you can be charged with a DUI if you refuse to take a test while displaying evident signs of impairment.

Requirements to Recover Your Driving License

If the test shows that your BAC is above the legal limit, the DMV will start the process of suspending your drivers license. You have 7 days to appeal this decision through a hearing, failing which you’ll have to fulfill some of the following requirements:

  • Obtaining an SR-22 insurance policy certificate
  • Enrolling in alcohol treatment classes depending on your BAC reading
  • Installing an interlock device on all vehicles you own or drive
  • Taking the drivers training exams again, including road, written, and eye
  • Send a completed certification form for first-time offenders

Reach Out to a Local DUI Lawyer

When an officer arrests you for a DUI, it’s because they have reason to believe that you were driving while impaired. However, this does not automatically mean that you are guilty until the judge or jury rules so.
